Dr. Miller, a family physician in Center, Texas (pop. less than 6,000) is a self-recognized expert in diagnosing amelanotic melanoma.

The primary care physician he testified against retired soon afterward, saying "It was time to quit."

We have proof that Dr. Miller has testified for the plaintiff over 45 times. We have no evidence that he has ever testified for the defense.

He is president of the Shelby-Sabine County Medical Society. It has thirteen members

Dr. Miller is on the Texas Medical Advisory Committee for Blue Cross Blue Shield of Texas. One of his duties is to review the charts of targeted physicians.

BCBS of Texas sent a primary care physician a letter noting "you have more higher level office visits than your peers".

She objected, and interpreted the letter to be an illegal attempt by the insurer to coerce her to downcode.

Under threat of termination, she submitted ten patient charts for review by Dr. Miller's committee.

Other insurers using the same tactics in other states was a hot debate topic on AAFP listservs. Primary care physicians typically undercode rather than upcode, according to AAFP.

Dr. Miller cited evidence to support the insurance company's claim she charged too much:

"She collected too much history for the purpose of coding higher level office visits."
